1. Agreement to These Terms

By signing up for or using DineBot at dinereserveai.com, you agree to these Terms of Service. If you don't agree, please don't use the service.

These terms apply to all users — restaurant owners who manage the platform ("Merchants") and customers who interact with DineBot-powered chatbots ("End Users").

If you are using DineBot on behalf of a business, you confirm that you have authority to bind that business to these terms.

2. What DineBot Does

DineBot is an AI-powered restaurant booking chatbot platform. It enables restaurant owners to:

  • Deploy an AI chatbot on their website to handle customer table reservations 24/7
  • Connect the chatbot to Telegram and Facebook Messenger (Pro/Premium)
  • Receive booking SMS alerts via Twilio (Pro/Premium)
  • Manage bookings, collect deposits, and send automated notifications
  • Monitor and manage reservations from an admin dashboard

The AI chatbot is powered by Anthropic's Claude AI. While we work hard to make the AI accurate and helpful, AI responses are not always perfect. Please review your bookings regularly.

How Billing Works

Subscriptions are billed monthly and renew automatically on the same date each month. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. Payments are processed securely by Stripe.

7-Day Money-Back Guarantee

Not happy within your first 7 days? Email us at [email protected] and we'll refund your first payment in full — no questions asked. After 7 days, payments are non-refundable.

Cancellation

You can cancel anytime from your admin panel or by emailing us. Your access continues until the end of the current billing period. We don't charge cancellation fees and we don't provide pro-rated refunds for partial months.

Account Deletion

If you use the Delete My Data tool to permanently remove your account, the same refund rules above apply: no refunds are issued for the current billing period, and account deletion does not entitle you to any refund of past payments. Your Stripe subscription is automatically cancelled at the moment of deletion so you won't be charged again, but money already paid is non-refundable. Deletion is permanent — please make sure this is what you want before confirming.

Price Changes

We'll give you at least 30 days' notice by email before any price increase. Your current rate is locked until we provide that notice.

4. Acceptable Use

DineBot is for legitimate restaurant booking and customer service. You must not:

  • Use DineBot for any illegal purpose or in violation of any law or regulation
  • Spam or send unsolicited messages to customers through the platform
  • Abuse or overload the AI API, attempt to bypass rate limits, or reverse-engineer the service
  • Collect customer data for any purpose other than managing your restaurant bookings
  • Resell, white-label, or sub-licence DineBot without a Premium plan
  • Impersonate another business or provide false information during setup
  • Use the platform to promote illegal services, adult content, gambling, or harmful products

We reserve the right to suspend or terminate accounts that breach these rules, without refund.

5. Your Responsibilities as a Restaurant Owner

When you use DineBot, you take on the following responsibilities:

  • Keep your admin link and PIN private. Anyone with your link can access your panel.
  • Keep your settings accurate. Outdated hours, availability, or pricing leads to bad customer experiences — and that is on you.
  • Honour confirmed bookings. If the AI confirms a booking, the customer has a reasonable expectation you will honour it.
  • Disclose the AI to customers. You must inform customers that they are interacting with an AI chatbot, as required by applicable law.
  • Comply with local data laws. You are responsible for ensuring your use of DineBot complies with privacy laws in your jurisdiction.
  • Handle customer disputes fairly. Booking disputes are between you and your customer — DineBot is not a party to those agreements.

6. AI Limitations — Please Read This

DineBot uses AI to handle customer conversations. The AI is powerful but not perfect. Here is what you need to know:

  • The AI may occasionally misunderstand a customer's request or provide incorrect information about your restaurant
  • The AI is not a guaranteed booking confirmation system — always cross-check with your dashboard
  • Payment screenshot verification is AI-assisted and is not a fraud-proof system — always verify actual receipt in your bank
  • The AI cannot access real-time data outside what you configure in your admin settings
⚠️ We are not liable for losses caused by AI errors, missed bookings, or incorrect responses. The AI is a tool to assist your operations — not a replacement for human oversight. Review your bookings regularly.

7. Deposits & Customer Payments

DineBot helps you collect booking deposits by allowing customers to upload payment screenshots. Important clarifications:

  • DineBot does not process or hold payments on your behalf at any time
  • You must verify actual payment receipt in your own bank or e-wallet account
  • DineBot's AI reads payment screenshots to assist you, but this is not a guarantee of payment
  • We are not liable for fraudulent screenshots, failed transfers, or disputes over deposits

8. Intellectual Property

All DineBot software, design, branding, and documentation is owned by us and protected by applicable intellectual property laws. You may not copy, reverse-engineer, or redistribute any part of the platform without written permission.

You retain ownership of your restaurant data and customer data. By using the service, you grant us a limited, non-exclusive licence to use that data solely to provide and improve the DineBot service.

9. Service Availability

We work hard to keep DineBot running but we cannot guarantee 100% uptime. Scheduled maintenance, third-party outages (including Anthropic's AI API), or unexpected incidents may cause temporary disruptions.

We are not liable for losses resulting from service outages or AI unavailability. We will communicate planned maintenance in advance where possible.

We may modify, update, or discontinue features of the service at any time, with reasonable notice for material changes.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, DineBot shall not be liable for:

  • Lost revenue, lost profits, or loss of business arising from platform use or downtime
  • Incorrect or missed bookings resulting from AI errors
  • Unauthorised access to your account due to a compromised admin link or PIN
  • Actions or failures of third-party services (Stripe, Anthropic, Twilio, etc.)
  • Indirect, incidental, or consequential damages of any kind

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.

11. Termination

Either party may end the agreement at any time:

  • You can cancel your subscription from the admin panel or by emailing us. Access continues until the billing period ends.
  • We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, abuse the platform, or fail to pay.

On termination, your data is retained for 90 days and then permanently deleted, unless you request earlier deletion or we are legally required to retain it.

12. Resolving Disputes

We'd rather resolve issues informally. If you have a problem:

  1. Email us first at [email protected] — we'll respond within 2 business days
  2. If we can't resolve it within 14 days, either party may escalate to formal proceedings
  3. All formal disputes are subject to the exclusive jurisdiction of Malaysian courts

We genuinely want to make things right. Most issues are resolved quickly with a short email.

13. Governing Law

These Terms are governed by the laws of Malaysia, including the Personal Data Protection Act 2010, the Consumer Protection Act 1999, and the Electronic Commerce Act 2006 where applicable.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14. Changes to These Terms

We may update these Terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Minor changes (such as fixing typos or clarifying language) may be made without notice.

Continued use of DineBot after the effective date of any update means you accept the revised Terms.
